Terms of Use
These terms are the agreement between you and Niky Dieben (“we”, “us”) covering your use of the Vinyl Index app. By using the app you accept them. If you do not, please do not use the app.
What the app does
Vinyl Index helps you catalogue a record collection: you photograph sleeves, the app proposes matching releases, and you keep the results in a searchable collection.
Identification is a best effort
Release identification is automated and will sometimes be wrong. Pressing details, catalogue numbers, values and edition information come from third-party music databases and may be incomplete or inaccurate.
Do not rely on Vinyl Index as the sole basis for a purchase, sale, or insurance decision. Verify anything that matters against the record itself.
Your account
You are responsible for keeping your sign-in details secure and for activity under your account. Tell us promptly if you believe it has been compromised. You must be old enough to form a binding contract where you live, and at least 13.
Acceptable use
You agree not to:
- Break the law, or infringe anyone’s rights, using the app.
- Attempt to bypass scan allowances, rate limits or access controls, or call our backend other than through the app.
- Scrape, bulk-extract or resell data obtained through the service.
- Upload images you do not have the right to use, or anything unlawful.
- Interfere with the service’s operation or other people’s use of it.
Your content stays yours
Your collection data and the photos you scan remain yours. You grant us only the permission needed to run the service for you: to process a photo for identification, and to store and sync the collection you build. We claim no ownership over it. See the Privacy Policy for what happens to scan photos.
Subscriptions and payment
Vinyl Index offers a free tier with a monthly scan allowance and a paid tier with a larger one. Where a paid subscription is offered through the App Store:
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the period ending.
- You can manage or cancel a subscription in your device’s Account Settings after purchase. Deleting the app does not cancel it.
- Prices and the current allowance are shown in the app before you purchase. Refunds are handled by Apple under their policy — we cannot issue them directly.
Unused allowance does not carry over between months.
Availability and changes
We may change, suspend or discontinue features. The app depends on third-party services, and identification may be degraded or unavailable when they are. If we discontinue the service entirely, we will give reasonable notice and a way to export your collection.
Ending the agreement
You may stop at any time by deleting your account. We may suspend or terminate an account that breaches these terms, or where required by law.
Disclaimers and liability
The app is provided “as is”, without warranties of any kind to the fullest extent the law allows. We are not liable for indirect or consequential loss, for lost profits, or for decisions made in reliance on identification results.
Nothing here limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all mandatory rights under the law of your country, and nothing in these terms overrides them.
Governing law
These terms are governed by the law of Belgium, without affecting any mandatory consumer protections you have where you live.
Apple
This agreement is between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
